1. Who we are and what the service is
Real3D.io is a platform by XTUDIO NETWORKS, with which a real estate developer publishes its projects in a 3D viewer with unit sheets, receives enquiries from interested buyers and manages them from a panel. By creating an account you accept these terms; if you act on behalf of a company, you declare that you have authority to bind it.
2. The account
The account belongs to the company that creates it. You are responsible for the password and for what is done with it; tell us as soon as you suspect unauthorised access. You may invite agents from your team within the limits of your plan; you are responsible for what they do on the platform.
3. Plans, trial and payment
Plans and prices are published on the platform. The free plan includes what is stated there; paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until you cancel.
The trial period of a paid plan starts when your viewer is published, not when you register: that way no trial is used up while we prepare your project. When the trial ends, the chosen plan is charged unless you cancel before. If a charge fails, we will let you know and retry; if it keeps failing, the account returns to the free plan and the 3D viewer stops being served, but your public page, your units and your enquiries are kept.
You can change plan or cancel at any time from the panel. On cancellation, the paid plan remains active until the end of the period already paid. There are no refunds for partial periods, unless applicable law provides otherwise.
4. Building the viewer
Our team builds the 3D viewer from the material you hand over: floor plans, renders, 360 images or video and, if you have it, the three-dimensional model. You warrant that you have the right to use that material and authorise us to reproduce and adapt it to publish it in your project. We undertake to build it within a reasonable time, which we tell you when we receive the material, and not to publish it without your approval.
5. Your content and the enquiries
Your project data (prices, availability, descriptions, photos) is yours and you are responsible for its accuracy and for compliance with your country's real estate advertising rules. The buyer enquiries you receive are third parties' personal data: you must process them to attend to their interest in the project and in accordance with the data protection law that applies to you.
6. Acceptable use
The platform may not be used to publish unlawful, misleading or infringing content, to send unsolicited communications, or to attempt to access other people's data or accounts. We may suspend an account that does so, with notice except in urgent cases.
7. Availability and liability
We work to keep the service continuously available, with daily backups and monitoring, but we do not guarantee there will be no interruptions. We are not liable for purchase decisions a third party makes based on the information you publish, nor for indirect damages or loss of profit. Our total liability towards you is limited to what you paid us in the twelve months before the event giving rise to it, except in cases of wilful misconduct or where the law does not allow limitation.
8. Closing the account and retention
You can delete your account from the panel. Doing so deletes your projects, units and enquiries, except what we must keep by legal obligation (billing). We recommend exporting your data first, which you can also do from the panel.
9. Changes to the service or to these terms
The service evolves; we may add, change or remove features. If a change to these terms affects you substantially, we will notify you in advance and you may cancel at no cost if you do not accept it.
10. Law and jurisdiction
These terms are governed by the law of the country where XTUDIO NETWORKS is domiciled. For any dispute, the parties submit to the courts of that domicile, without prejudice to the rights granted to you as a consumer by the law of your residence.
